Privacy Policy

Your privacy is important to us at MySpecialDiet.com ("Site"), a service of Nutricia North America (“SHS”). We understand that your health and diet are a very personal subject, and we want you to feel as comfortable as possible visiting our Site and using its services. While you may be visiting the Site for yourself or on behalf of someone else, this Privacy Policy and Agreement ("Privacy Policy") will tell you what information we collect about you and how it is protected. By using the Site, you agree to the terms of this Privacy Policy and all other applicable policies such as the Terms and Conditions. This policy is limited to the collection and use of information collected on the Site.

This Privacy Policy is intended to comply with any obligations under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).

A. Information Collection and Use

1. General
Personally identifiable information (“Personal Information”) is information that can be used to identify you or to contact you (i.e. name, e-mail address, address, phone number, etc). When you visit the Site, MySpecialDiet.com collects only the Personal Information you voluntarily provide to us for services you request. We may also collect additional information, such as birth dates and information about your condition to better serve you.

We collect the Personal Information that you provide in various ways, including:
(a) when you join or you edit information submitted in association with MySpecialDiet.com membership (“Member Information);
(b) when you register to receive our e-Newsletter;
(c) when you purchase a product from our online store; and
(d) when you wish to participate in one of our interactive forums, including chat rooms or posting boards.

2. Join MySpecialDiet.com and Edit Member Profile
In order to access certain services and content, you are required to become a member. We use Personal Information to provide you with the services you request and information that we believe is of interest to you. We may also use Personal Information to contact you. You can opt-out of receiving such communications at the time you join or by editing your Member Information. You can also edit your Member Information/Account by e-mailing us at customerservice@shsna.com

3. Newsletter
You may register to receive our e-Newsletter by clicking on “Member Profile” and opting in to receive the e-Newsletter or by submitting your e-mail address at the designated place.

4. Tell A Friend
When you use MySpecialDiet.com's "Tell a Friend" feature, MySpecialDiet.com sends an e-mail to your friend's e-mail address, lists your e-mail address as the sender, and provides the information you requested be sent. MySpecialDiet.com uses the friend's e-mail address only for the purpose of sending your friend the e-mail you requested. We do not store your friend's e-mail address.

6. Orders
When you order products on MySpecialDiet.com we request information on our order forms. You must provide shipping contact information (like name and address) and billing information (like billing address, credit card number, expiration date). This information is used for billing and shipping purposes only. If we have trouble processing an order, this contact information is used to contact you.

7. Public Forums
Please know that any information (including personal and health-related information) you reveal in a MySpecialDiet.com public forum (such as a message board, gallery, Sound Off, chat room/event, or similar electronic public venues) is not protected by this Privacy Policy. Such postings will be seen by MySpecialDiet.com members and/or guests and third parties not related to MySpecialDiet.com. What you write could be used by others in ways beyond our control or predict, including contacting you for unauthorized purposes. Also, if you access a third party web site from a link on the Site, any information you reveal on that site is not subject to this Privacy Policy. You should consult the privacy policy of each web site you visit.

8. Anonymous Data
We may place a “cookie” – a non-personally identifying computer code -- on your browser to help navigate the site. We may also collect information as to the traffic on certain pages of the site.

Periodically, we may run polls. Responses to the poll are anonymous. The date and time, IP address, and vote for each vote cast is recorded to ensure accuracy

B. Security
MySpecialDiet.com strives to keep your Personal Information as secure as possible. MySpecialDiet.com uses encryption technology in transmitting your Personal Information to our servers to help maintain its security.

C. Disclosure of Your Information
MySpecialDiet.com will not disclose any Personal Information it gathers from you on our Site except as described below or as specifically agreed to by you. We may release Personal Information to third parties: (1) to comply with valid legal requirements such as a law, regulation, search warrant, subpoena or court order; or (2) in special cases, such as a physical threat to you or others, or (3) with your consent. In the event that we are legally compelled to disclose your Personal Information to a third party, we will notify you, unless doing so would violate the law or court order

1. Disclosure to Linked Sites
For your convenience there are links to websites not operated by MySpecialDiet.com ("Third Party Websites"). These links may be found referenced within content, or placed beside the names or logos of support organizations or product vendors. MySpecialDiet.com does not disclose your Personal Information to these Third Party Websites without obtaining your consent. MySpecialDiet.com does not endorse and is not responsible for the privacy practices of these sites. If you choose to link to one of these Third-party Websites, you should review the privacy policy posted on the other site to understand how that Third Party Website collects and uses your Personal Information.

2. Disclosure of Aggregate Information
MySpecialDiet.com may provide to third parties non-personal information about your visit that does not allow you to be identified or contacted and that is combined with the non-personal information of other users. For example, we might inform third parties regarding the number of users of our site and the activities they conduct while on our site, i.e., "30% of our users live in the eastern United States" or "25% of our users are related to a certain metabolic disorder."

3. Business Transfers
In the event that Nutricia North America undergoes a corporate restructuring or sale, user information, including personally identifiable information, may be transferred to the new entity. By submitting your personal information to the Site you agree that your data may be transferred to such parties.

D. Information about this Privacy Policy
If you have a complaint or problem regarding privacy, you may e-mail us at customerservice@shsna.com. We try to answer every e-mail in a timely manner. If you do not receive adequate resolution of a privacy related problem, you may write to MySpecialDiet.com's Privacy Officer at: SHS North America, Human Genome Sciences Campus, 9900 Belward Campus Drive, Suite 100, Rockville, MD 20850.

If we change our Privacy Policy, we will post those changes on the Site so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If at any point we decide to use Personal Information in a manner different from that stated at the time it was collected, we will seek your consent.

E. Children’s Privacy Policy

SHS encourages you to get permission from your parents before sending any information about yourself over the Internet, to us or to anyone else.

A Note To Parents
PLEASE READ. This section of the privacy policy explains our information collection and use practices online for children under the age of thirteen, including what we do with information that we collect and with whom we share that information. We ask that you take the time to review our policy so that you can know exactly how we collect and use information from kids, and so that you will know how you can review or request that we delete your child's information. If you ever have any questions or concerns about this policy, please contact us at: customerservice@shsna.com. This privacy policy is intended to comply with the Children’s Online Privacy Protection Act (“COPPA”).

1. What Information We Collect From Children Under Thirteen
Except as provided herein, MySpecialDiet.com does not collect personal information from children under thirteen years of age without parental consent. However, in the near future, children may sign up on the Children’s Corner portion of the Site to receive a children’s newsletter. To do so, children submit their e-mail address along with a parent’s or guardian’s. We are prohibited by law from collecting more information than these e-mail addresses in conjunction with this newsletter. Upon receipt, we will send a newsletter to the child. At the same time, we will send you an e-mail informing you that your child has subscribed to the newsletter. If you do not want your child to receive the newsletter, please contact us and we will delete your child’s address from our records. If we do not receive a response from you, we will continue to send the newsletter until you or your child requests us to stop. Please note: If we do not receive a response from you requesting that we delete your child's information, your consent to your child's receipt of the newsletter will be presumed.

If we become aware that we have inadvertently received personally identifiable information from a user under the age of thirteen, other than in a legally permissible situation, we will delete the information from our records as soon as we discover it. As a parent or guardian, you may exercise your right to have your child's information deleted at any time. Additionally, you may review your child's personally identifiable information at any time. See Parent's Rights, below.

2. How We Use Information We Collect From Children Under Thirteen
When we collect personally identifiable information from children under the age of thirteen, we will use that information only for the express purpose for which it was collected, i.e., transmission of a children’s newsletter. The information will not be used for any other purpose and the information will not be used after a request to delete the information has been received from the child or you.

We do not share information collected from children under the age of thirteen with any third parties except those parties that help us administer our Site and/or our newsletters. These third parties may not use the information for any other purpose, and have agreed to maintain the confidentiality, security and integrity of the information.

Additionally, in the unlikely event that all, or substantially all, of our assets are sold or transferred to another party, all e-mail addresses collected and saved by us may be transferred to the acquiring party. Finally, we may disclose your child's e-mail address to third parties in order to comply with the law, to law enforcement agencies, to protect our rights in or the safety of the Site, or to protect the safety or rights of other users of our web sites.

3. Cookies and Non-Personally Identifiable Information
To help make the Site more responsive to the needs of our visitors, we invoke a standard feature found in browser software, called a "cookie," to assign each visitor a unique, random number, a sort of anonymous user ID that resides on your computer. The cookie doesn't actually identify the visitor, just the computer that a visitor uses to access our site. A cookie can't read data off your hard drive. We do not link cookie data with personally identifiable information, nor do we store a child’s personal information in our cookies. You can disable cookies at any time by changing the preferences in your browser.

Also, MySpecialDiet.com keeps records of certain non-personally identifiable information such as the number of hits a Web page receives, IP address, and other aggregate data. We do not link this aggregate data with any personal information. Third parties that help us administer our Site may have access to this non-personally identifiable, aggregate data. However, these third parties are bound to keep this information confidential.

4. Parent's Rights
We want you to be comfortable with what your child is doing on the Site. Therefore, you may contact MySpecialDiet.com at any time regarding privacy questions or concerns, or to request to review personally identifiable information we have collected from your child. You may also contact us at any time to request that we delete your child's personally identifiable information, and/or refuse to permit further collection or use of your child's information. We will take steps to ensure that any person contacting us for a child's information is that child's parent or guardian.
